This is interesting but not surprising from a con court who fails to see the bigger picture. If a police officer does not read you your miranda rights then the confession is thrown out and you cannot be convicted based on the confession. I think that is the justice contemplated by failure to read Miranda rights. It should be a clear mark on the record of the cop because if you catch a person who committed the crime but a dumb cop forgets COP 101 and the DA has to throw out the case, the cop should be punished to send a message just like if you fuck up in any job. I can see why a victim or victim's family would want to sue the police for negligence and I think I can support that just like a doctor or hospital can be sued for malpractice if the employees fail to follow proper procedure. Imagine your daughter is raped and they catch the guy and fucktard bob forgets to miranda the guy so his confession is thrown out and there is no other evidence. The more I think about it.... mirandas are given after a suspect is arrested..... there is no snap decision or life or death situation... it is easy to remember to do and not something you have to do while being shot at or stabbed. The suspect is often in handcuffs or subdued. I think the city should be sued if one of its employees fails to follow procedure through negligence which causes a failure to perform their duty.
