The fired employee is not going to sue the player's union, they are going to sue the team and most likely win because they discriminated againt non-players in their rules and policy on who gets fired and who doesn't. You cnanot have a player and a coach walking into the same building and say one is fired for not getting vaxxed but the other is not. That is pretty arbitrary and makes no reasonable sense when both are occupying the same space and same contact with others in the facilities.
Let's address this in more detail to make everything clear. Coaching staff in the NFL are not protected by the players union. Coaches can be let go for any reason without recourse -- and regularly are. Some NFL teams go through coaching staff faster than a Southern redneck goes through cheap beer. A fired coaching employee is not going to be successful in any lawsuit -- they can be dismissed at any time for any reason -- nor are they entitled to the same job protections as unionized employees. The players in the NFL are protected by a players union. The agreements made with the union guide the requirements for the treatment of players when it comes to employment. You can treat unionized employees and non-unionized employees differently when it comes to employment terms -- businesses all over the U.S. already do this. The NFL teams are trying to put the maximum screws to unvaccinated players since an unvaccinated player spreading COVID can cost the team greatly in terms of wins, finances, and league standing. Sadly the player union does not support making COVID vaccinations mandatory for the players.
Coaches can be fired for cause like any other employee in the world. However if tell a coach that there is a health crisis and they need to be vaccinated or lose their job and players do not have to, the coach has a viable lawsuit. You keep coming at this from the point of view of the player's union. The player's union means shit to the coach and his lawsuit against the team. You are basically saying is a union employee can require an employer to discriminate against non-union employees when they come up with company wide policies. In your world, a union employee cannot be fired for getting pregnant but a non-union employee can. In your world, a union employee cannot be fired for having AIDS but a non union employee can. Stop quoting the players, they have nothing to do with this. A coach who was fired can walk into any court with a discrimination lawsuit and get a big settlement because the policy is completely arbitrarya nd backwards. Also the union means shit becuase players can have games forfeited with NO PAY.... you think the union agreed to that/
Yes... a non-unionized employee can be treated differently in terms of grounds for firing than a unionized employee. There is decades of legal precedence for this. Likewise a employer can fire an employee for not being vaccinated -- there are recent legal suits that demonstrated this. Bottom line - coaching staff that refuse to be vaccinated and are fired are not going to get satisfaction in the courts. And yes -- the NFL players union agreed to all the guidelines for players. The teams are just taking them to the extreme in order to get the message across.
Sorry this has no precedent and we are talking about a health crisis... Mandating coaches be vaccinated to have a safe work environment is punched full of holes when you say players don't need to be vaccinated. Why are you mandating coaches and staff be vaccinated? There is no rationale that makes sense if players do not have to be vaxxed. Claiming union membership is bullshit. Unio membership can get you more benefits collectively than non-union employees. But cannot be used to make company wide policies and then discriminate. Not being unionized is not against the law. It does not allow you to set a company wide health policy based on federal health guidelines and then fire some poeple. let me try this again... you run a machien shop... non-unionized worked must wear goggles and gloves or be fired. Unionized workers do not need to wear anything. That is a lawsuit that the court will easily provide a monetary remedy for the people fired. Has nothing to do with unions.... you are not making any legal sense here.
Let me say --- Lawyers, the team owners, the players union, and others disagree with your above assertions. Get back to me when a single dismissed coach is successful in suing an NFL team for being fired for being unvaccinated.
https://profootballtalk.nbcsports.c...y-discussions-with-rick-dennison-are-ongoing/ Owners are trying to avoid getting sued by paying coaches to not be there if they refuse to get vaccinated....this is not over...
