Kristi Noem’s Department of Homeland Security included Durham County, North Carolina on her list of counties that are "sanctuary jurisdictions" which have "official policies, laws, or practices that hinder cooperation with immigration enforcement or limit compliance with detainer requests from U.S. Immigration and Customs Enforcement (ICE)". The problem is that Durham County is one of the few local counties which has cooperated with federal judicial detainer requests for many years under Sheriff Clarence F. Birkhead, all aligned with state law as well. The biggest issue actually is getting ICE to respond when they are called. Strangely some other local counties which don't cooperate were not included by the DHS on the list. "In a statement released Friday, the Durham Board of County Commissioners (BOCC) and the Durham County Sheriff's Office refuted the designation, calling it "neither supported by law or facts." Why did Durham County get this unsupported designation from Kristi Noem’s Department of Homeland Security? Probably because many of the county officials and the sheriff are black in the opinion of many locally. Or possibly Kristi Noem is confusing statements from left-wing Durham City officials with Durham County. However the county runs the jail and holds all the power when it comes to cooperating with detainer requests in our state -- and Durham is a model of proper legal cooperation.
